STAGE 1: Get a Legal Opinion : FIND OUT IF YOUR MORTGAGE HAS BEEN SECURITISED.

 Step 1: Contact the Clear Your Mortgage Team

Step 2: Our friendly staff assess your case 

Clear Your Mortgage will assess you case from the information you give them. We will instantly be able to inform you if you have a viable case to make an application.

Step 3: SIGN UP

At sign up you will have to pay the fixed Registration and Admin fee of £260 using your debit or credit card.

You can call us on 0330 043 9896 or simply fill in your details on the contact form of our website and we will call you back ASAP.

During the call we will answer any queries and if you are happy to proceed we will obtain your information and enter your details on our secure portal and proceed to the authorisation for payment of £260.00.

You will be registered and notified by email that the payment has been completed and you will also receive an invoice for all services along with a copy of the T&C’s and a copy of your electronic signature. No card details are retained as the payment is made on secure system.

Step 4: Validation Team

Once you are registered the Validation Team will email you a formal letter of authority, to act on your behalf and deal with your lender, which you must sign as an original document. This letter of authority, together with a copy of the mortgage statement and a passport or driving licence copy for each of the named mortgage holders must be sent back BY POST to: Clear Your Mortgage, Avix Business Centre, 42-46 Hagley Road, Edgbaston, Birmingham, West Midlands,B16 8PE

Step 5: Validation Confirmation

A Data Subject Access Request (“DSAR“) to the bank/lender under the Data Protection Act (1998) is submitted by the Validation Team on your behalf and the statutory 40 days period should now commence.

Upon receipt of the DSAR documents* from your bank/lender, a formal review of the data is carried out and a legal opinion is provided by the solicitor's Validation Team relative to the strength of a potential challenge. If after receiving the legal opinion you choose to instruct the Solicitor's Validation Team to continue with any action(s), you may then proceed to Stage 2 - The Dispute Process.

*Due to the complex matter it has come to our attention that some of the lenders choose to send documentation under the DSAR directly to the client to delay the process  even though they were instructed not to do so by Clear your Mortgage. This is beyond our control and should any documentation be received all clients are instructed to deliver the same to: Clear Your Mortgage, Avix Business Centre, 42-46 Hagley Road, Edgbaston, Birmingham, West Midlands, B16 8PE
